It has been nearly five months since a young woman was allegedly gang raped by three Duke University Lacrosse players. Since then, the accuser has given police more than three different stories about the night she performed at the lacrosse player’s party. So where are we in this case and why, despite significant evidence that the three players charged in this alleged crime are innocent, has DA Mike Nifong not dropped the charges?

Liberals want to see this case played out in court. They falsely believe an indictment amounts to a guilty verdict. A grand jury only hears the DA's witnesses with no rebuttal. The truth is, as the saying goes, "a grand jury will indict a ham sandwich if the DA is committed."

This DA is oblivious to the facts. Think about this: the alleged victim has a prior criminal record, is an alcoholic and drug user. She stated in her initial report to the police, that there were three dancers and five attackers. Later she said that there were only two girls and three attackers. The three accused men have tight alibis and there is no DNA evidence linking them to the alleged crime.

Not only will he not drop the case, he is not affording the defendants their constitutional rights. The 6th amendment says, “the accused shall enjoy the right to a speedy...trial.” Their trial is not slated for another 8 or 9 months. Assuming there are not more delays, it will be at least one year since the two's arrest before their trial.

The 8th amendment protects the defendant from excessive bail. Excessive bail is based largely on the risk and probably of the defendant to flee. Bail was set at $300,000. Why so much? These boys are in school, have little money of their own, and have been on the news around the country. They are not going anywhere.

I guarantee if a conservative DA had handled the case this way, liberals would be kicking and screaming. Mike NiFong, the Durham DA has said repetitively that he has clear evidence. Where is it?

It is clear that the DA has used this case to gain the support of the minority electorate to get reelected. If he did use this case to get reelected, it is inexcusable and the Durham community should be outraged and have him removed from office.

Everyday, it appears more and more that the Duke Rape Scandal is a fraud pressed by a democratic DA in his successful bid for reelection.
